1. INTRODUCTION – WHO WE ARE AND WHAT WE DO? 

We are the flagship brand of CricOptions Analytics Pvt. Ltd., offering our platform to you and an opportunity for you to participate in option trading spanning across a broad range of officially sanctioned live cricket matches.
Any person using, accessing and/or participating in any trade on Our Platform is a user (“User”). All references to “You/Your” relate to the User. All references to “We/Us/Our” relate to “CricOptions” which denotes a collective reference to the CricOptions mobile application and the CricOptions app (herein after collectively referred to as “Platform”).

2. ACCEPTANCE OF OUR TERMS AND CONDITIONS

Your continued usage of our platform constitutes your acceptance of the terms and conditions, including any additional terms that we may make available to You (“Terms”) and are contractually binding on You.

You accept that in the event of any variance between these terms and any additional terms relating to the usage of Our Platform, the additional terms will prevail.

By accepting these Terms, You agree and consent to receive communications from Us and/or Our partners, licensors or associates for any purpose through the following modes:

  1. Announcements;
  2. Administrative messages/direct messages;
  3. Advertisements;
  4. Direct notification to your account; and
  5. By any other means that We may consider fit for this purpose.

You agree that You shall mark Us as a safe sender on all Your platforms where You receive any such communications from Us (including via email and SMS) to ensure such communications are not transferred to the spam/junk folder. By using the CricOptions platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the CricOptions platform.

User Consent: By accepting these Terms and Conditions, Users are providing their consent to receiving communications such as announcements, administrative messages, and advertisements from CricOptions or any of its partners, licensors, or associates.

3. USER ACCOUNT

i. You are required to register on Our Platform to create an account to access Our Services (“Account”). At the time of creating Your Account and/or at any time during the utilisation of Our Services, You will be required to provide any and/or all of the following information and/or documents:

  • Your full name;
  • Your mobile number;
  • Your full address and state of residence;
  • Your gender; and
  • Your date of birth.
  • Aadhar number
  • Any other valid identification
  • Bank Account information
  • UPI ID
  • Permanent Account Number (PAN)

We reserve the right to conduct KYC as may be required from time to time in the manner prescribed under such law.

4. ELIGIBILITY

i. To participate in any trade, you must meet the following eligibility criteria:

  • You must be above the age of 18 years.
  • You must be residing in India.
  • You must have a valid Indian mobile number to create an Account.

ii. Trading on CricOptions is not permitted in the following states (“Restricted States”):

  • Andhra Pradesh;
  • Assam;
  • Nagaland;
  • Sikkim; and
  • Telangana

iii. You agree that You are not from any of these Restricted States and You shall refrain from making any false disclosures, declarations and/or representations to Us to circumvent the applicable laws and/or regulations of the territory of India (“Applicable Law”) of the Restricted States to participate in any trades.

iv. Contractual Competence: Any User who is “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including minors, undischarged insolvents, etc., is not eligible to enter into this Agreement with CricOptions. For the purpose of CricOptions services offered by CricOptions, an “Agreement” shall mean these Terms and Conditions, the Privacy Policy, and any other rules or policies available on the CricOptions platform, including all other additional or modified terms and conditions and policies in relation to the CricOptions platform or any current or future services that may be offered by CricOptions. This Agreement is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011. This Agreement is an electronic record generated by a computer system and does not require any physical or digital signatures.

5. YOUR CONDUCT 

In using and accessing Our Platform, You agree to observe the following code of conduct:

    1. ACCOUNT INFORMATION
      • You are permitted to create only one Account on Our Platform. When creating Your Account with Us (or updating Your Account information), You agree that You will provide true, accurate and updated information and documentation. You will not provide any false and/or incorrect information and documentation nor impersonate or attempt to impersonate and/or otherwise assume the identity of another person without due authority. You will not commit any such fraudulent act which amounts to forgery and/or involves the fabrication of documentation.
      • You agree and acknowledge that the address-related details provided by You shall be treated as Your “Address on record” for the purposes of the Goods and Service Tax Act.
      • You agree that You shall promptly update your Account related details on Our Platform in the event of any change in such details and/or write to Our Help and Support in the event of any;
        a) change in Your Account related details and/or;
        b) any unauthorised use of Your Account to enable us to take remedial action.
    2. MAINTAIN CONFIDENTIALITY
      • You will maintain the confidentiality of all information relating to Your Account, and You will not share Your One Time Password (“OTP”) with any other person;
      • You will not engage in any fraudulent conduct in logging into another user’s account by asking for their account-related information or taking their OTP.
    3. COMPLIANCE WITH APPLICABLE LAW
      • You agree to comply with Applicable Laws.
      • You agree that You shall not commit any illegal act that disrupts Our systems.
    4. VIOLATION OF PLATFORM TERMS
      • CricOptions reserves the right to initiate appropriate action against users engaging in any activity which violates our terms and conditions and disrupts the level playing field which impacts our users.
      • You shall not violate any of the Terms in using and accessing Our Platform and Services;
      • You shall not misuse any Discount and/or any other offers or promotions given by Us.
      • You agree that you shall use the Platform and Our Services solely in Your personal capacity, and You will not engage in malpractices or collude with other Users in deriving any benefit and/or running any business in connection with the use of Our Platform and/or Services.
      • You shall not be engaged in any form of insider trading, i.e. illegally sharing and seeking non-public information, knowledge of participating teams in any given contests/match, strategies, organizing boards, leagues etc. which may give You an unfair competitive advantage.
      • You shall not tamper, modify, or otherwise deal with our data, content, software, technology and/or Intellectual Property by any means.

Without limiting the foregoing, Users agree not to use CricOptions for any of the following:

    • To advertise, offer or sell any goods or services for any commercial purpose on CricOptions without the express written consent of CricOptions
    • To collect or store personal information about other Users
    • To interfere with or disrupt the CricOptions and/or the CricOptions Platform, CricOptions servers, or CricOptions networks
    • To impersonate any person or entity, including, but not limited to, a representative of CricOptions, or falsely state or otherwise misrepresent User’s affiliation with a person or entity
    • To take any action that imposes an unreasonably or disproportionately large load on CricOptions’s infrastructure
    • Unauthorized access to the CricOptions Platform is a breach of these Terms and Conditions, and a violation of the law. Users agree not to access the CricOptions Platform by any means other than through the interface that is provided by CricOptions via the CricOptions Platform for use in accessing the CricOptions Platform. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of our sites, except those automated means that we have approved in advance and in writing.

6. DISCLAIMERS 

  1. We will not be liable for any delay or failure to render the Services resulting from any Force Majeure Event.
  2. You may access Our Platform at Your own risk. We are not responsible or liable for any loss or damage (including injuries, death, or loss of property) that You or anyone else may suffer while accessing Our Platform.
  3. You agree that Our Platform may contain third-party advertisements and links to websites/services owned and operated by Our affiliates and/ or third parties (“Third Party Content”). We do not endorse the Third Party Content or services of any third parties included on Our platform. We cannot guarantee the accuracy, reliability or quality of such Third Party Content. Your reliance on Third Party Content is at Your own risk. Any claims that You have regarding Third-Party Content should be directed to the third party in question.
  4. We will not be held responsible for any issues with the storage, deletion, delivery, or accessibility of information or materials to the extent allowed by law.
  5. We do not provide any warranty for Our Content, which is provided on an “as is, as available basis”.
  6. We are not responsible for any errors or inaccuracies in the option chain, as it is calculated by the algo by using data obtained from external sources or publicly available information.
  7. We are not responsible for any inaccuracies in calculating the option price/market price of any strike due to inaccurate or incomplete information received from any third-party service provider.
  8. We will not be liable for your inability to access Our Platform for any reason beyond our control such as network outage, telecommunication failure, internet suspension, virus, malware etc.
  9. We are not responsible for any errors in communication, or omissions in communication, including any errors made by You, which may prevent the results from responsibly by making informed decisions and playing within Your means. You are encouraged to seek help if needed.
  10. To the extent permitted under law, neither CricOptions nor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis- delivery, or the untimely delivery of any information or material.
  11. To the extent permitted under law, CricOptions shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, products, CricOptions Services or sites.
  12. Any material accessed, downloaded or otherwise obtained through the CricOptions Platform is done at the User’s discretion, competence, acceptance and risk, and the User will be solely responsible for any potential damage to User’s computer system or loss of data that results from a User’s download of any such material.
  13. Calculation of option premium is purely dependent on our in-house model, and CricOptions reserves the right to modify it at any time.
  14. CricOptions shall make best endeavours to ensure that the CricOptions is error-free and secure, however, neither CricOptions nor any of its partners, licensors or associates makes any warranty that:
    • The CricOptions Platform will meet Users’ requirements,
    • CricOptions Platform will be uninterrupted, timely, secure, or error free
    • the results that may be obtained from the use of CricOptions Platform will be accurate or reliable and the quality of any products, CricOptions Services, information, or other material that Users purchase or obtain through the CricOptions Platform will meet Users’ expectations.
  15. Match Disruption: In case of rain or any natural reasons if the match is called off or the number of overs is reduced, all active trades will be nullified. Resumption of Trading- If the match restarts with the same number of overs, users can resume trading and will be able to see their active trades. If the match restarts with less number of overs, users can resume trading by placing new orders (all previous orders will be nullified).
    • CricOptions will not be responsible for any financial loss in case of any glitch or technical issue.
    • Execution of trades is purely dependent on the buyer and seller’s bid.
    • Brokerage will be Rs.10/order.
  16.  Premiums will increase in case of consecutive sixes and fours (or probability of reaching the target increases). Premium will decrease if there are consecutive dot balls, singles and wickets (or probability of reaching there decreases)
  17.  Cash Bonuses (if any) can only be redeemed on the CricOptions platform.
  18.  CricOptions have all the rights to change the referral and redeem policy at any point of time.
  19.  CricOptions will not be responsible for any financial loss due to any human error like any fat finger trade by the user.
  20.  Trading will be done in lots. Each lot has 10 option contracts. In one order, a user can trade 10 lots at max.
  21.  In case, a user wants to trade 16 lots, then trade will be divided in two orders: Order 1: 10 lots and Order 2: 6 lots.

7. Refer & Earn with CricOptions

8.Grievance Redressal Mechanism 

i. In case a User has any complaints or grievance pertaining to (a) any Content that a User believes violates these Terms (other than an infringement of Intellectual Property Rights), (b) Users’ access to the CricOptions Platform or (c) any Content which a User believes is, prima facie, in the nature of any material which is obscene, defamatory towards the complainant or any person on whose behalf such User is making the complaint, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, please share the same with us by writing to: support@cricoptions.com

ii. In the complaint or grievance, the User shall include the following information:

  • Name and contact details: name, address, contact number and email address
  • Relation to the subject matter of the complaint, i.e. complainant or person acting on behalf of an affected person
  • The name and age of the person aggrieved or affected by the subject matter of the complaint, in case the User is acting on behalf of such person and a statement that the User is authorised to act on behalf of such person and to provide such person‘s personal information to CricOptions in relation to the complaint/grievance
  • Description of the complaint or grievance with clear identification of the Content in relation to which such complaint or grievance is made
  • A statement that the User believes, in good faith, that the Content violates these Terms and Conditions
  • A statement that the information provided in the complaint or grievance is accurate.
